The ECHA Candidate List of "Substances of Very High Concern" Now Contains 223 Chemicals

On 2022-01-17, ECHA (the European Chemical Agency) added 4 new hazardous chemicals to the Candidate List for SVHCs (Substances of Very High Concern), as detailed below:

Significance:

The Candidate List of SVHCs now has 223 chemicals that may harm people or the environment.

 

These substances may be placed on the Authorisation List in the future. Inclusion on that list means that the use of the substance is prohibited unless a company receives an authorisation to continue its use from the European Commission.

 

Consequences of the Candidate List:

REACH Regulation

Under the REACH Regulation, companies have legal obligations when their substance is included – either on its own, in mixtures or in articles – in the Candidate List.  Any supplier of articles containing a Candidate List substance above a concentration of 0.1% (weight by weight) has to give sufficient information to their customers and consumers to allow safe use.  Consumers have the right to ask suppliers whether products they buy contain substances of very high concern.

 

Waste Framework Directive

Companies also have to notify ECHA under the Waste Framework Directive if their products contain substances of very high concern in a concentration above 0.1% (weight by weight).  This notification is published in the SCIP database on the Agency's website.

 

Group Entry on the Candidate List

It is also noteworthy that an earlier group entry on the Candidate List has been changed.  The group entry "Nonadecafluorodecanoic acid (PFDA) and its sodium and ammonium salts" previously included two entries: "Decanoic acid, nonadecafluoro-, sodium salt" and "sodium nonadecafluorodecanoate".  These two names describe the same substance and are equivalent, therefore "Decanoic acid, nonadecafluoro-, sodium salt" has been removed from the list.

 

Effective Date:

Importers and producers of articles have to notify ECHA if their article contains a Candidate List substance by 2022-07-17. Suppliers of the substances on the Candidate List (supplied either on their own or in mixtures) have to provide their customers with a safety data sheet.
